Abstract of Title

A condensed history of all recorded documents and proceedings that affect the title to a specific parcel of real property.


Definition

An abstract of title is a summary of all conveyances, liens, encumbrances, and legal proceedings found in the public records that relate to a particular property. It is prepared by a title company or abstractor and provides the basis for a title opinion or title insurance policy. The abstract itself does not guarantee clear title; it simply reports what the records show. In New York, an attorney typically reviews the abstract before issuing a title opinion.

Exam Tip

An abstract summarizes the chain of title but does not guarantee it. Title insurance protects against defects that the abstract may miss.
