Government regulations that divide land into zones and restrict how property in each zone may be used.


Definition

Zoning is a form of police power that divides a municipality into districts and specifies permitted uses — residential, commercial, industrial, agricultural. Zoning ordinances also regulate building height, density, setbacks, and lot coverage. A property that was lawfully built before a zoning change becomes a nonconforming use. Property owners who want a different use can apply for a variance.

Exam Tip

Zoning = police power = no compensation. A variance is an exception. A special use permit allows a specific use with conditions.
