Lead-Based Paint Disclosure

A federally required disclosure informing buyers and renters of known lead-based paint hazards in housing built before 1978.


Definition

Federal law requires sellers and landlords of residential properties built before 1978 to disclose any known lead-based paint or lead-based paint hazards. The buyer or tenant must receive the EPA pamphlet 'Protect Your Family from Lead in Your Home.' Buyers (but not tenants) must be given a 10-day period to conduct a lead-based paint inspection. The disclosure must be in writing and signed by all parties. In New York, Local Law 1 imposes additional lead paint requirements in New York City for apartments with children under six.

Exam Tip

Pre-1978 housing = lead paint disclosure required. Buyers get 10 days for inspection. This applies to sales AND rentals.
